Acceptance of Terms

Your access to or use of any DriftMarkety Store service constitutes your agreement to abide by these Terms of Service together with all applicable federal, state, and local laws and regulations of the United States. Should you disagree with any portion of these terms, you must refrain from using DriftMarkety Store's offerings entirely. Anyone using the service on behalf of a company or other organization confirms that they hold the authority to bind that entity to these terms.

Use of the Website

You agree to use DriftMarkety Store's services exclusively for lawful, personal, non-commercial purposes unless DriftMarkety Store has granted you explicit written authorization otherwise. You must not:

• Send unauthorized advertising, promotional material, or spam through our platform
• Attempt to access our systems, user accounts, or inventory databases without authorization
• Impersonate any person or entity, including DriftMarkety Store staff or other users

• Submit fraudulent, excessive, or malicious orders, including orders placed with no intent to receive them

Product Information and Pricing

DriftMarkety Store works diligently to keep product descriptions, pricing, specifications, and availability details accurate and current. Should an error arise in product information, pricing, or availability, we may correct the error and cancel any orders placed based on the incorrect information at no cost to you. For items with natural variability (such as handmade or natural material goods), slight variations in dimensions, weight, or appearance from listed specifications may occur. Product information and warnings are provided for reference only; DriftMarkety Store cannot guarantee that products are free from cross-contamination during processing or packaging. Product availability may vary by delivery zone, pickup location, and selected time slot.

Orders and Payment

Every order is contingent upon product availability and acceptance by DriftMarkety Store. We may refuse or cancel any order at our sole discretion, including orders that appear fraudulent, breach these terms, or cannot be fulfilled due to stock shortages. Payment must be received in full before order dispatch or pickup, unless otherwise agreed in writing. Minimum order values and delivery fees may apply based on your selected delivery zone and time slot. For age-restricted products (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age requirement to purchase such items in your jurisdiction, and valid government-issued ID will be required at delivery or pickup. If an item in your order is out of stock, we will notify you prior to dispatch and may offer a suitable substitute, or issue a refund for the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All content on DriftMarkety Store's platforms — including text, images, logos, software, private label product packaging, and the "DriftMarkety Store" name and branding — is the exclusive property of DriftMarkety Store and is protected by applicable copyright, trademark, and intellectual property laws of the United States. You may not reproduce, distribute, modify, or create derivative works from any DriftMarkety Store content without our express written permission. User-generated content (including product reviews, photos, and comments) submitted to our platforms may be used by DriftMarkety Store for marketing, promotional, or operational purposes, subject to our Privacy Policy.

User Responsibilities

You bear responsibility for keeping your account credentials confidential and for all activities conducted under your account. You must notify DriftMarkety Store immediately of any unauthorized use of your account or any other security breach. You are likewise responsible for supplying accurate, up-to-date contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you submit are truthful and complete. If you place an order on behalf of a third party, you alone are responsible for ensuring that third party meets all legal eligibility requirements for purchased products, including age restrictions for restricted goods.

Limitation of Liability

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of DriftMarkety Store's services shall first be submitted to DriftMarkety Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

DriftMarkety Store may update, modify, or replace any part of these Terms at any time at our sole discretion. Should we make material changes to these Terms, we will provide at least 30 days' advance notice via email to the address associated with your account, or via a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms.
